Namibia scraps colonial-era anti-gay laws

The High Court in Namibia on Friday struck down two colonial-era laws that criminalise same-sex acts between men, marking a significant victory for the LGBTQ community in the country.

This decision came after Namibian activist Friedel Dausab, supported by the UK-based NGO Human Dignity Trust, challenged the laws. 

Dausab expressed his joy, stating that it is a monumental day for Namibia, as loving someone of the same sex will no longer be a crime, Reuters reported.

While convictions under these laws were rare, they contributed to discrimination against the LGBTQ community and instilled fear among gay men. 

Namibia inherited these laws on gaining independence from South Africa in 1990, although same-sex acts between men were initially criminalised under colonial rule. 

South Africa has made significant progress by decriminalising same-sex sexual activity and granting rights such as adoption, marriage, and civil unions to LGBTQ couples, the SABC news reports.

On the other hand, Uganda recently implemented one of the world’s strictest anti-LGBTQ laws, which includes the death penalty for “aggravated homosexuality.” This move by Ugandan President Yoweri Museveni has faced widespread condemnation from Western nations and could lead to potential sanctions from aid donors. 

Uganda has implemented harsh anti-LGBTQ laws, including the death penalty, despite facing global criticism.

In Burundi, President Evariste Ndayishimiye’s controversial remarks promoting the stoning of gay people in that country have raised concerns about the increasing anti-LGBTQ sentiments in the East African region and beyond.

While Ndayishimiye’s statements do not hold legal weight, they contribute to the hostile environment faced by LGBTQ individuals in many African nations, where discrimination, violence, harassment, and social stigma continue to be significant challenges.
